Mikko Eloranta rewarded with Veikko Palotie grant

Merilampi Attorneys, together with Paulo Foundation, annually awards a grant to a post-graduate student for a praiseworthy master’s thesis. This year the Veikko Palotie Award was granted to LL.M. Mikko Eloranta. The award consists of Veikko Palotie medal and a grant of EUR 4 000.

Mikko Eloranta’s thesis aims to clarify the prerequisites for a court to find a company filing a patent infringement lawsuit to be abusing its dominant position forbidden in the TFEU 102 article, and to compare the decisions of the CJEU and the EGC to decisions made by US courts. The thesis also handles the problem of defining the relevant geographical and product markets from a patent holder’s point of view. In addition, the thesis explores the possibility of a holder of a standard essential patent to file injunctions without violating competition laws. The wider context of the thesis is finding the right balance between intellectual property law and competition law. (Summary by Mikko Eloranta)
