The New Act on Public Procurement into force on 1 June 2007 – a new book also available
The Act applies only to procurements whose value exceeds new national thresholds. For goods and services the national threshold value is EUR 15 000 (for health and social services EUR 50 000) and for construction services EUR 100 000. The Act obliges procurement entities to publish a notice at an Internet-based notice channel HILMA (www.hankintailmoitukset.fi). The companies interested in public procurement deals should actively follow the notice channel in order to get information on tender competitions. The legal remedies available for companies have remained mainly in their previous form also after the reform. However, the companies’ risk being obliged to cover procurement entities’ legal costs at the Market Court has increased as a result of the new Act.Our Specialist Counsel, Attorney-at-Law Erkko Ruohoniemi has published, together with Saila Eskola, a handbook named “Julkiset hankinnat” (public procurement in Finnish). In the book the procurement process and the various available contract award procedures are set out in a clear and detailed manner from the planning stage to the reasoning of a procurement decision. The book covers both the procurement entities’ and the companies’ point of view and embodies special sections on the legal remedies as well as the new Act on Utilities Procurement. The book concentrates on the commentary of the new Act on Public Procurement but it also contains interesting and useful case-law, and answers many practical questions often raised in the everyday work.
