Merilampi represented Fortum in the landmark Fortum/E.ON Finland competition case at Market Court.
In June 2006 the FCA set conditions to the acquisition of E.ON Finland by Fortum claiming that Fortum was in a dominant position at the market of production and wholesale of electricity and that the acquisition strengthened this position resulting in significant impediment of efficient competition in Finland. The Market Court found in its ruling that the FCA had no grounds for setting the conditions because Fortum cannot be considered to have a dominant position in production and wholesale of electricity neither before nor after the merger. In the ruling, described as a landmark case by the Chief Justice of the Market Court, Mr Kimmo Mikkola, the Market Court accepted Fortum’s view that the relevant geographic market for production and wholesale of electricity is wider than national covering at least Finland and Sweden.
